The following message was sent to 230 news, current affairs, business and technology editors of Australian media outlets on April 19, 2005.
Pyramid schemes are a blight on society, even when they are disguised with names like "multi-level marketing" and "network marketing". A new player entered the Australian MLM field on November 1, 2004. It was Australian Communications Network Pty Ltd. Actually, that was the day when they officially opened for business as a reseller of telephone calls. They had been recruiting distributors and collecting "training fees" for some months before that. It took only until November 23 for the ACCC to start legal action for pyramid selling. In March this year, ACN was found by the Federal Court to be acting in breach of the Trade Practices Act by operating a pyramid scheme. ACN took the decision badly and have been trying since then to pretend that nothing serious has happened to them. One sign of their displeasure is that they do not like me expressing an opinion about them or their activities, and have been exploiting a feature of the Copyright Legislation Amendment Act 2004 to try to have my web site taken down.
They have now claimed copyright infringements on two occasions. On the second occasion the material referred to did not come from one of their web sites, although the take-down demand said that it did. My ISP was still obliged to act to get me to remove the material. The actions of ACN in this case were simply intended to irritate both my ISP and me, as there would have been almost no chance that they could have prevailed if the alleged copyright infringement had gone before a court.
I am writing to you because I promised ACN that I would give them and their activities the widest possible publicity. ACN has shown that they are prepared to break the law, they have effectively ridiculed the Federal Court judgement and announced that it is "business as usual", they pretend to be a telephone company (they sell memberships in a pyramid) and they are expanding their activities across Australia. The last thing any multi-level marketing organisation wants is publicity, because that can scare off potential victims.
A copy of the letter I sent to ACN's lawyer is attached.
My comments about ACN, as well as the content of their two threats and my correspondence with some of their representatives can be found at http://www.ratbags.com/rsoles/comment/acn.htm
