Hey everybody!
Hope you don't mind that I write in English, but it is much easier to express myself this way.
It is about a voucher for a service which was bought on socialdeal, but I haven't received any service neither refund.
This is my first post, so please don't hesitate to comment or say if I have made something wrong.
Now- story time. I will try to keep it short. (Damn, didn't work)
To be precise, before the summer vacation on May 11th I have bought a coupon from #socialdealMaastricht for 49,- for a service- car cleaning, from a company called #Prospeed Car Cleaning. Soon after, I have called the company and made the appointment on 20th . They were supposed to come and take my car for a whole day, clean it and bring it back later the same day. I was waiting them exactly the same day at the address I gave, for one hour, called them, they did not picked up my calls nor arrived.
So I have contacted SocialDeal about it, strangely enough it took them as far as I remember between 7 to 9 days to reply back. I have all the e-mails and the communication but shortly they had stated that 14 days period have passed so they cannot refund me, so I was explaining them the situation and they
were stating that they had called the company and the entrepreneur said "there were no problems, client was satisfied" and similar things, what is obvious lie. Furthermore, I was calling the company so many times and they have never picked up the phone.
So I have complained about it to social deal, and social deal replied that they did not have any problems with contacting them, like I should try again, when I am getting obviously ignored.
Anyway, I was tired of all this and went there myself, in private to company's address to make another appointment. That was already beginning/middle of June. Surprisingly the soonest appointment they
could've plan for me was in SEPTEMBER! September 19th. Ok, so I thought that I can give them another chance, if at least they do their job.
Weirdly enough, even though I bought a "special package" which includes car pick up for 5Eur in a distance of 20km, they have asked me to pay them extra 15Eur for picking up the car. Well, I agreed because I did not have any other possibility, and I thought at least it will give me a guarantee that they
will show up this time.
Guess what. No. They didn't. Same stsory, was waiting, calling. Nothing. So I have wrote and called to social deal again. And here it started the same story "we didn't have any problems with contacting the company", and even in the last mail they have said "we spoke with the company and they
said that two times they were waiting next to your door and you weren't there". This LIE doesn't even fit with their story before, when they said that the company were there and client had no problems. Not mentioning that I WAS there, I WAS waiting, WAS calling them.
So. What about social deal. They just offered to contact the company again. SERIOUSLY? After all this? And sadly enough they choose to believe those guys but not me.
Moral; seems like #SocialDealMaastricht and #Prospeed Car Cleaning work
together to scam people. Or I was unlucky enough to pick rotten apple from social deal page and jump on the most grumpy client service's member. I hope I was the only one, but if not, please let me know, I believe this could be a case.
To be honest, didn't have any problems with other deals, but this time it is just completely nonsense, how social deal client service works and how hardily ProSpeedCarCleaning lies.
If anybody would have an idea about this it would be very helpful. Please share your thoughts and tips. Hope you will help me to find a solution in this absurdly situation.
The best greetings to all the forum members:)

You could make your text a lot more readable by reformat it. Firstly do no use a return in the middle of your sentences. And secondly use a white space after each paragraph. In the first paragraph you can talk about he agreement. In the second part about the disservice. Then the complaint ect. Now I have to fish for the facts, arguments, ect.kiausiukas schreef:Hope you don't mind that I write in English, but it is much easier to

I think your arguments are
1. You bought a voucher for a service. In this agreement there was no date when the service had to be delivered.
2. You made an appointment but the company never showed up.
3. The company states that they did show up but you where not there.
I would say you have a write for the service and not for you money back. In order to have a right for your money back you either have make a case that support you have a write on this for 12 months instead of the standard 14 days ("het herroepingsrecht") of you would have a written letter (and being able to prove the company received your letter) where you give the company a reasonable time to provide there service with an warning that otherwise you want your money back.

Thank you for tips! I have made it tiny bit more readable, but all your tips will definitely use the next time!
Question; when you mention a letter, would an e-mail be fine in this case? I think this is the only possibility how I can prove that they have got it, when they reply to me. And how do you think, is 2 weeks a reasonable period of time?
The only thing which I am afraid now is that if they actually will arrange an appointment, they can damage my car, because as I have checked their official site, they mention that everything what they do is on own, client risk. (What kind of company would say that)

Re: No money, no service, no refund.
An e-mail would be fine. You can provide they recived it if the ISP is willing to help or if the responded. In general 14 days is an resonal period for an responce. So if you write something like: "14 days to setup an appointment" then that would be fine.
This is an unfair term and can be destroyed by you or an judge, unless the company proves that it if fair. A contractual term which has not been individually negotiated shall be regarded as unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties' rights and obligations arising under the contract, to the detriment of the consumer.kiausiukas schreef:The only thing which I am afraid now is that if they actually will arrange an appointment, they can damage my car, because as I have checked their official site, they mention that everything what they do is on own, client risk.
